Van Hollen Statement on Judge Xinis Ruling that Kilmar Abrego Garcia be Returned to Maryland

Today, U.S. Senator Chris Van Hollen (D-Md.) released the following statement regarding Judge Xinis’ ruling that Kilmar Abrego Garcia must be returned to Maryland upon release in the Tennessee proceedings:

 

“Today’s ruling is important to upholding the rule of law against a lawless Trump Administration. Every person in our nation is afforded the right to due process by our Constitution. Despite the Trump Administration’s efforts to defy our Constitution and deny that right, I am glad to see Judge Xinis’s ruling today. It’s clear this Administration would rather deport Kilmar Abrego Garcia to a third country, with no chance at due process, than argue their case in court. This order will prevent that, and ensure that Kilmar Abrego Garcia is returned to Maryland following the U.S. District Court in Tennessee’s determination that he does not pose any threat to the public. This ruling also requires that, prior to any attempts to remove Mr. Abrego Garcia from the United States, he receive due process and a hearing before an immigration court. While I have no doubt the Administration will continue working to undermine the rights of Mr. Abrego Garcia, we will continue fighting to see them upheld in a court of law – because threatening the rights of anyone in this nation poses a threat to the rights of all.”
